1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Carevly Pro website and services. By creating an account, submitting a booking, or otherwise using our services, you agree to be bound by these Terms.
Please read these Terms carefully before using our services. If you do not agree, do not use our services.
2. Our Services
Carevly Pro provides professional residential cleaning, office cleaning, and lawn maintenance services across Australia. Services are subject to availability and may vary by location.
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
3. User Accounts
3.1 Registration
You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information and to keep it updated.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised access.
3.3 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms or that are used for fraudulent or unlawful activity.
4. Bookings and Scheduling
4.1 Booking Requests
All booking requests are subject to confirmation by Carevly Pro. A booking is not confirmed until you receive a written confirmation from us.
4.2 Access to Property
You agree to ensure our team has safe and unobstructed access to the property at the agreed time. Failure to provide access may result in a cancellation fee.
4.3 Cancellations and Rescheduling
Cancellations or rescheduling requests must be made at least 24 hours before the scheduled service time. Late cancellations may incur a fee at our discretion. We reserve the right to reschedule services due to unforeseen circumstances (e.g. severe weather) and will notify you as soon as possible.
5. Pricing and Payment
5.1 Pricing
Service prices are quoted at the time of booking confirmation and are subject to change. Final pricing may be adjusted based on the actual scope of work or additional requirements identified on-site.
5.2 Payment Terms
Payment is due in accordance with the invoice issued after service completion. Advance deposits may be required for certain bookings. Overdue invoices may incur late payment fees.
5.3 Loyalty Discounts
Loyalty discounts are applied automatically based on completed service history and are subject to the terms displayed in your account dashboard. We reserve the right to modify or discontinue the loyalty programme at any time.
6. Customer Conduct
You agree not to:
- Provide false or misleading information in your account or booking requests.
- Harass, threaten, or intimidate our staff or team members.
- Use our services for any unlawful or fraudulent purpose.
- Attempt to gain unauthorised access to our systems or other accounts.
- Interfere with or disrupt the operation of our website or services.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Carevly Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services.
Our total liability for any claim arising from or relating to our services shall not exceed the amount you paid for the specific service giving rise to the claim.
Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence, or any liability that cannot be excluded under Australian Consumer Law.
8. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure of a service, and to compensation for any other reasonably foreseeable loss or damage. If a service fails to be of acceptable quality and the failure does not amount to a major failure, you are entitled to have it re-performed.
9. Intellectual Property
All content on the Carevly Pro website, including logos, text, images, and software, is the property of Carevly Pro and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
10. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Governing Law
These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of the relevant Australian state or territory.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by email. Continued use of our services after changes take effect constitutes your acceptance of the updated Terms.
